"The Town Board was forced to put this new DRAFT WIND LAW on their website after a Freedom Of Information (FOIL) request.
This DRAFT is subject to changes but we are advised that the Town Board has said that they WILL follow the recommendations
of the Citizens' Committee.
PLEASE STAY TUNED......we will closely follow what is happening and keep you informed."
One Heart of Henderson member noted the following:
This DRAFT was posted on the Town of Henderson website... July 21. It is a .pdf with editing corrections shown in color.
But there seems to be important information missing, such as:
1) a setback of 4500 feet from Route 3
2) a setback of 2000 feet from any public road in the Town of Henderson
3) no commercial wind energy facilities on the Stony Point peninsula
4) a spacing of 2000 feet from turbine to turbine
5) a height limit of 400 feet from ground to blade tip
6) a noise limit of 5 dBA over quiet ambient
7) some (yet-to-be-determined) setback from wetlands
8) insurance protection for loss of property value
9) the property owner is ultimately responsible for taking down a wind tower
if all else fails.
10) the ridge along the Henderson Bay shoreline is not to have wind towers
Also, all the notes and comments (apparently 32 of them) were not included when
the MS Word document was converted to a .pdf.
Citizens attending the HEARING on Tuesday, July 20 were not allowed by the Town Supervisor to READ the DRAFT or make copies even
though the document was right there on the table and reference by the Supervisor during the meeting.
There are qualifiers that affect the set-backs-
#1--The map assumes that all property owners in the turbine permitted areas will allow turbines
#2--The minimum set-back is 2000' from roads as well as "non-participating" property lines ( non-participating
means that the adjacent property owner has not given an easement allowing closer approach or higher noise levels)
#3--The adjacent, ( non-participating ), property owner is not to suffer any increase above 5 dBL at the property
line ( the measure for ambient noise level will be determined by the quietest time of the day- usually evening or night)--most
wind turbines will require a set-back well over 3000' to meet the average rural ambient of 30dBL.
The Henderson Wind Zoning Committee met on 1/16/2010.
It will meet hereafter every 2ND Friday at 1:00PM at the
Town Meeting Hall (fire barn hall)-It will be open to a public comment period.
On 1/16/2010:
Town Supervisor Ray Walker addressed the group:
1. He requested the Committee add a Town Board Member to the group--- It was agreed
that a Town Board member should attend and comment but would not be allowed a vote.
2. He requested the Committee to send regular reports to the Town Board---It was agreed
that a summary of topics discussed would be presented.
3. He requested the Committee to advertise meetings (by advising the Town Clerk),
of all planned meetings--- This was agreed to.
4. He requested all copy work to go through the Town Clerk- This was declined.
5. He stated that the Town Clerk would receive the final report of the Committee
and make it available to Board Members , the Town Board would consider the Committee's
proposals and then they would write the wind zoning laws. The Henderson Citizens' Wind
Zoning Committee advised Mr. Walker that each Board Member would receive a copy of its
complete proposal package and the Committee would then meet with the Board within two
weeks to review the proposal. Mr. Walker did not commit to such an arrangement.
6. Mr. Walker gave no indication as to the Town Board's position on the Wind Laws---his
comments as to his studies appeared to reflect a neutral or slightly pro-wind stance.
7. Mr Walker stated he felt that, as a Town appointed Citizens' Committee, we should
only deal with the wind zoning laws. It was the decision of the Citizens' Wind Zoning
Committee that the data supporting of our decisions should and would be made public.
The Henderson Citizens' Wind Zoning Committee will not address non-commercial wind turbines
but will concentrate on on Commercial Wind Turbines. The recommendation of NO COMMERCIAL WIND TURBINES
will be considered while at the same time formulating laws that will reflect the latest scientific evidence
in support of the siting of commercial wind turbines. Siting will consider the effects on health, scenic views,
tourism,and property values.
